The Department of Labor’s Wage & Hour Division’s final rule on overtime will likely return in October, says the agency.

The final rule, “Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees under the Fair Labor Standards Act,” was set to take effect December 1, 2016. It would have, among other things, doubled the salary threshold for exempt workers. The rule was struck down by an injunction just a week before it was to take effect

In July 2017, DOL published a request for information, asking the public “to provide information that will aid the Department in formulating a proposal to revise these regulations.”

In September 2018, DOL hosted listening sessions to receive public input on questions related to the rule. It was announced that the department planned to revise the 2016 final rule and issue a proposed rule in October. A public comment period would also be announced on the federal register.
