Colorado proposes new overtime and minimum pay standards |

On Monday, December 16, Colorado Department of Labor and Employment (CDLE) will hold a public hearing to discuss Colorado Overtime and Minimum Pay Standards Order (COMPS order) #36. The proposed rule would clarify which workers are covered by overtime and minimum wage orders. It would also raise the salary threshold for workers exempt from overtime. The COMPS order would “presumptively cover all employees, unless specifically excluded.” It would also raise the minimum salary threshold for so-called “white collar” workers to $817.31/week ($42,500/year)—higher than the proposed increase at the federal level. That threshold would then increase by $3,000 each year through 2026, putting the minimum salary threshold for exemption at $1,105.77/week or $57,500/year. The comment deadline for the proposed rule is December 31, 2019.
